Á partir de un hecho educativo cotidiano se plantea la alternativa filosófica e irresoluble entre el determinismo y la libertad, proponiendo un enfoque compatibilista que significa que pese a que la acción humana individual hace parte de cadenas causales, somos libres de quebrar o innovar en cualquiera de los eslabones de dichas cadenas, posibilitando así la responsabilidad moral y la ética, y (...) permitiendo un acto realmente formativo. Los aportes de Descartes y Kant, así como de Pestalozzi y Makarenko permitirán proponer la educación como anticipación en un contexto preciso. (shrink)

El mundo actual vive un proceso de globalización. Eso da lugar a desacuerdos políticos que pueden originar guerras civiles o nuevos conflictos inconcebibles en el pasado, como el atentado terrorista en las Torres Gemelas de Nueva York (2001) o en la estación de Atocha de Madrid (2004). Como consecuencia ha habido intervenciones internacionales cada vez que se ha considerado necesario. Así (respetando siempre los acuerdos internacionales), las Fuerzas Armadas españolas han actuado en distintos territorios. Esas Fuerzas representan por primera vez (...) a la sociedad española, incluidos las mujeres y los inmigrantes con especiales relaciones con España. (shrink)

Este artículo plantea el inicio, desarrollo y evolución de la lucha por las libertades en el CSIC, incardinándola en el proceso que tuvo lugar en toda España y con el que lógicamente, coincide en sus líneas generales. El hecho de que la situación en el CSIC no tuviera la repercusión social de la que tenía lugar en otros Centros homologables —la Universidad, por ejemplo— responde a situaciones específicas del Consejo, analizadas por la autora. El trabajo se centra en la situación (...) madrileña, perspectiva explicable por la similitud del proceso a nivel general, por el peso de los Centros madrileños en el Organigrama nacional del CSIC y por la observación participante de la autora que desearía que pronto se multipliquen análisis de este tipo referidos a otras autonomías resaltando sus indiscutibles especificidades. En este artículo se analiza la construcción de sentidos del pasado dictatorial chileno a través de micro-narraciones cotidianas. Se realiza a partir del estudio de tramas de memoria local conformadas en la vida cotidiana de un barrio de Santiago de Chile, dentro de las cuales uno de sus componentes centrales son las micro-narraciones, o lo que ha sido descrito en otros contextos como memorias fragmentadas. El objetivo de este artículo es comprenderlas como forma de memoria y analizar su rol en (...) los procesos de transmisión intergeneracional a nivel local. Con ello, se ponen en tensión aquellos planteamientos que observan la fragmentación desde las dificultades que representa para la comunicación del pasado, en tanto forma que desafía los modos convencionales de narración. Tal como muestra la investigación etnográfica, en el contexto de un territorio cargado históricamente de conflictos, esta forma de memoria tiene especial preeminencia respecto de la constitución de referentes cotidianos que participan de procesos de identificación y arraigo en los jóvenes. Esta crisis se expresa en una cultura fundada en la ideología de la corrupción dentro de los valores del neoliberalismo. Los dirigentes de la derecha participaron en la corrupción de la dictadura militar, en la democracia se siguió con la misma práctica argumentando que así se lograba mantenerla. El empresariado intenta eludir los impuestos.Las instituciones sociales fundamentales han participado de esta cultura: gobierno, partidos, iglesias, universidades, empresariado y ejército. El control ha fracasado y excepcionalmente hay un par de jueces eficaces.Los (...) proyectos del gobierno son la repetición de la Ley de Probidad y Transparencia de 1994 que sacralizó el relativismo ético. La corrupción debe ser derrotada con la ética de los principios y su estudio por las universidades, la definición de las iglesias, los jueces y las organizaciones de los trabajadores públicos. La alternancia política sólo implicaría que un partido corrupto sería reemplazado por otro similar en el poder. (shrink)

El autor postula que a partir de la dictadura militar de Pinochet, la corrupción empieza a aparecer en el sector público subrepticiamente hasta generalizarse, y que con el retorno a la democracia se pensó que la probidad seguirá siendo una característica nacional, pero la corrupción se mantuvo y sigue desarrollándose, pasando de una corrupción de acuerdo a las normas a una corrupción hipócrita, hasta llegar a una corrupción justificada y cada vez más masiva. El artículo fundamenta estas propuestas.

Revisionism in the theory of moral responsibility is the idea that some aspect of responsibility practices, attitudes, or concept is in need of revision. While the increased frequency of revisionist language in the literature on free will and moral responsibility is striking, what discussion there has been of revisionism about responsibility and free will tends to be critical. In this paper, I argue that at least one species of revisionism, moderate revisionism, is considerably more sophisticated and defensible than critics have (...) realized. I go on to argue for the advantages of moderate revisionist theories over standard compatibilist and incompatibilist theories. (shrink)

ABSTRACT In Mexico informed consent is a legal requirement that ensures that patients who are invited to participate in clinical trials are provided with all the information needed to decide whether to participate, or not, in a research protocol. To improve our understanding of the problems physicians in developing countries encounter, when obtaining informed consent (IC), we examined their opinion on the importance of IC in clinical research, the quantity and quality of the information provided to the participant, and the (...) conditions in which the IC is obtained. Investigators considered that IC was useful to the patients, providing information that helped the patient to make a decision about his/her participation. Nevertheless, they felt that for some aspects of the research, like drug development in general, the use of placebos, and the randomization process, many of the patients were not capable of fully understanding the information provided, referring to the complexity of the information and illiteracy as the main reasons. Many investigators were not acquainted with some of the guidelines established in the Mexican General Law of Health,1 36% of them admitting to not having completed their IC letters. Most investigators gave only minutes to the patient to make a decision and 20% of ICs were obtained while the patient was hospitalized. Except for one investigator, all of them considered that specific training in medical ethics would be useful for the daily clinical work. (shrink)

Many prominent theories of moral responsibility rely on the notion of “tracing,” the idea that responsibility for an outcome can be located in (i.e., “traced back to”) some prior moment of control, perhaps significantly antecedent to the proximate sources of a considered action. In this article, I show how there is a problem for theories that rely on tracing. The problem is connected to the knowledge condition on moral responsibility. Many prima facie good candidate cases for tracing analyses appear to (...) violate the knowledge condition on moral responsibility. So, either we need to dispense with tracing approaches or we must refine our understanding of the knowledge condition or we are responsible less frequently than we suppose. (shrink)

RESUMEN Este artículo, después de situar, etimológica e históricamente, los conceptos de utopía y distopía realiza un breve vistazo a la doctrina pesimista de Schopenhauer, para luego mostrar cómo Émile Zola la articula y la despliega en una distopía, en ciertos pasajes de La alegría de vivir. Se concluye, a través de varias preguntas, cómo Zola ficciona, en la figura de su personaje Pauline, una pequeña isla de felicidad dentro de un enorme océano pesimista, inquietante y malévolo: la utopía y (...) la distopía surgen entrelazadas en una ficción que, historiando y politizando la cuestión, muestra cómo lo filosófico aparece en la ficción novelesca cuando ha sido colocado allí a propósito. ABSTRACT This reflective article, after situating, etymologically and historically, the concepts of utopia and dystopia, takes a brief look at Schopenhauer's pessimistic doctrine, to then show how Émile Zola articulates and deploys it in a dystopia, in certain excerpts from The Joy of Living. It is concluded, through several questions, how Zola fictionalizes, in the figure of his character, Pauline, a small island of happiness within a huge pessimistic, disturbing, and malevolent ocean: utopia and dystopia emerge intertwined in a fiction that, historically, and politicizing the issue, shows how the philosophical appears in fictional fiction when it has been placed there on purpose. In recent years, reflection on the relationship between individual moral responsibility and determinism has undergone a remarkable renaissance. Incompatibilists, those who believe moral responsibility is incompatible with determinism, have offered powerful new arguments in support of their views. Compatibilists, those who think moral responsibility is compatible with determinism, have responded with ingenious counterexamples and alternative accounts of responsibility. Despite the admirable elevation of complexity and subtlety within both camps, the trajectory of the literature is somewhat discouraging. Every dialectical stalemate between (...) incompatibilists and compatibilists seems to be superseded by a similar though often more subtle stalemate.1 The stalemates have two sources. On the one hand, incompatibilists again and again find powerful intuitive support from our folk concept. On the other hand, compatibilists seem right to insist that even if determinism were true, this would not mitigate our need for a concept of responsibility. (shrink)

Nomy Arpaly rejects the model of rationality used by most ethicists and action theorists. Both observation and psychology indicate that people act rationally without deliberation, and act irrationally with deliberation. By questioning the notion that our own minds are comprehensible to us--and therefore questioning much of the current work of action theorists and ethicists--Arpaly attempts to develop a more realistic conception of moral agency.

In this article I propose a resolution to the history issue for responsible agency, given a moderate revisionist approach to responsibility. Roughly, moderate revisionism is the view that a plausible and normatively adequate theory of responsibility will require principled departures from commonsense thinking. The history issue is whether morally responsible agency – that is, whether an agent is an apt target of our responsibility-characteristic practices and attitudes – is an essentially historical notion. Some have maintained that responsible agents must have (...) particular sorts of histories, others have argued that no such history is required. Resolution of this contentious issue is connected to a wide range of concerns, including the significance and culpability of different forms of manipulation, the plausibility of important incompatibilist criticisms of compatibilism, and of course, a satisfactory account of moral responsibility. As it turns out, history matters sometimes, but less frequently than we might think. (shrink)

In contemporary philosophy of the cognitive sciences, proponents of the ‘Hypothesis of Extended Cognition’ have focused on demonstrating how cognitive processes at times extend beyond the boundaries of the human body to include external physical devices. In recent years the HEC framework has been put to use in cases of “socially” extended cognition. The guiding intuition in this paper is that exploring the cognitive incorporations of genuinely social elements may advance HEC debates. The paper provides an analysis of emotion regulation (...) in ‘dyadic synchronic interaction’ between infant and caretaker and argues that some ‘socially extended’ cases of cognition cannot be captured with the HEC. Instead, the ‘Hypothesis of Emergent Extended Cognition’ is introduced that complements the HEC and helps in understanding how cognitive properties are sometimes irreducibly emergent, non-programmed properties of coupled social systems. It will be concluded that operating with the HEEC leads to both a more precise grip on the explanandum and to a more robust explanans. (shrink)

Building Better Beings: A Theory of Moral Responsibility argues that the normative basis of moral responsibility is anchored in the effects of responsibility practices. Further, the capacities required for moral responsibility are socially scaffolded. This article considers criticisms of this account that have been recently raised by John Doris, Victoria McGeer, and Michael Robinson. Robinson argues against Building Better Beings’s rejection of libertarianism about free will, and the account of desert at stake in the theory. considers methodological questions that arise (...) from the account of desert, providing some additional resources for thinking about these issues within the framework of the account. McGeer objects to the particular mode of justification used to motivate the prescriptive aspect of the account. This article presents replies to each of these lines of response. (shrink)

I discuss the ontology and normativity of affordances by suggesting that their ontology can be dualist and that their normativity, although socioculturally shaped, has an affective biological value….

Prior research has unveiled a pathologization effect where individuals perceived as having bad moral character are more likely to have their conditions labeled as diseases and are less often considered healthy compared to those viewed as having a good moral character. Moreover, these individuals are perceived as less unlucky in their affliction and more deserving of it. This study explores the broader impacts of moral character on such judgments, hypothesizing that these effects reach deeper and extend to both negative and (...) positive moral evaluations. The pathologization effect also raises concerns about potential discrimination and the overmedicalization of normal health variations, so we also examine whether providing more detailed descriptions of conditions mitigates the influence of judgments of moral character. The methodology and broader implications of our findings are discussed, emphasizing the need for a deeper understanding of how moral judgments might influence patient care. (shrink)

As to the last paragraph, the most striking feature of the inner morality of law is that it is such a possible characteristic, surplus quality which is not a sine qua non, which law is conceivable without. However, it (...) is a question whether law can long do without it? In principle, the legislator is free in deciding on what legal consequence he attaches to what course of conduct14 and it is also desirable that legal concepts be freed from moral overtones. Nevertheless, the legal complex cannot be torn out of its social context, nor can it steadily conflict with other complexes (religions, moral, or political values, norms and ideologies) law is to develop in living interrelationship with. Otherwise, it is subject to danger that (I) law-observance in average cases is weakened; (2) the reified functioning of and approach to law are strengthened and make law alienated; and (3) it blurs the social objectives the law intends to serve and, especially in hard cases, makes its application rootless and floating. A pathological situation only becomes more pathological, if the pathology of contents is accompanied by the pathology of means. Or, it brings the promise of real solution closer, if the adequateness of means also provides, by the strength of publicity, for the direct mobilization of society. The question of how we actually arrive at our knowledge of others’ mental lives is lively debated, and some philosophers defend the idea that mentality is sometimes accessible to perception. In this paper, a distinction is introduced between “mind awareness” and “mental state awareness,” and it is argued that the former at least sometimes belongs to perceptual, rather than cognitive, processing.

Husserl has undoubtedly considered himself being influenced by Brentano, but his conflicts with the orthodox core of the School of Brentano raise the question whether his adherence to Brentano suffices to adequately grasp the context of his early philosophy. I investigate the biographical details of Husserl’s studies in Vienna to uncover hitherto unknown ties between Husserl and Austrian philosophers outside the School of Brentano. Already during his secondary school studies in the Austro-Hungarian Monarchy Husserl was exposed to the philosophy textbooks (...) of Gustav Adolf Lindner; and archival records of the University of Vienna show that he had extensively attended philosophy courses held by other philosophers, especially by Robert Zimmermann. Both Lindner and Zimmermann proposed Herbartian philosophies, and what makes Zimmermann especially interesting is that he had once been a close personal disciple of Bernard Bolzano. I use an unpublished lecture transcript, written by a fellow student of Husserl, to investigate the controversial issue of Zimmermann’s possible transmission of Bolzano’s ideas. While a direct transmission seems improbable, my investigation uncovers a plethora of Herbartian influences, which are interesting on their own terms and have not only furnished Husserl with important parts of his descriptive psychological toolbox but have also helped him navigate the Brentano-School’s debate on intentionality. El interés no es comprobar la existencia de Dios, sino simplemente saber si el lenguaje religioso como tal tiene o no sentido. Para esto, primero veremos la concepción de la creencia en general. A continuación, trataremos las creencias religiosas bajo dos puntos de vistas totalmente opuestos: por un lado, se expondrá la posición de autores (...) que dicen que las creencias religiosas sí tienen una evidencia razonable que las sustenta y, por otro, nos encontraremos con autores que afirman que dichas creencias no pueden ser justificadas racionalmente porque lo espiritual refiere el ámbito de lo indecible, en el cual no es factible afirmar que los enunciados religiosos son apropiados a ser verdaderos o falsos. La llegada del Tratado de Libre Comercio a Colombia sella la unión entre el Estado y el modelo económico neoliberal, en el que irónicamente se propone la reducción del mismo a la mínima expresión. Como consecuencia de este postulado se avecina una supresión de lo público quedando en manos de los particulares el manejo de las necesidades de los ciudadanos como meros aspectos de mercado. ¿Qué se globaliza? y ¿qué no se globaliza? The idea of moral responsibility is central to a wide range of our moral, social, and legal practices, and it underpins our basic notion of culpability. Yet the idea of moral responsibility is increasingly viewed with skepticism by researchers and scholars in psychology, neuroscience, philosophy, and the law. Building Better Beings: A Theory of Moral Responsibility responds to these challenges, offering a new account of the justification of our practices and judgments of moral responsibility. Three distinctive ideas shape the account. (...) The first is the agency cultivation model, which holds that a system of responsibility practices can derive its justification from the way it supports our agency. The second idea, circumstantialism, is a new way of thinking about agential capacities. This is the view that the capacities required for moral responsibility are functions of agents in circumstances, rather than basic features of agents considered in themselves. The third idea is revisionism, or the idea that a satisfactory theory of moral responsibility will conflict with some aspects of ordinary commitments about freedom and moral responsibility. (shrink)

Neil Levy (2007) argues that empirical data shows that psychopaths lack the moral knowledge required for moral responsibility. His account is intriguing, and it offers a promising way to think about the significance of psychopaths for work on moral responsibility. In what follows we focus on three lines of concern connected to Levy's account: his interpretation of the data, the scope of exculpation, and the significance of biological explanations for anti-social behavior.

I discuss experimental work by Nichols, and Nichols and Knobe, with respect to the philosophical problems of free will and moral responsibility. I mention some methodological concerns about the work, but focus principally on the philosophical implications of the work. The experimental results seem to show that in particular, concrete cases we are more willing to attribute responsibility than in cases described abstractly or in general terms. I argue that their results suggest a deep problem for traditional accounts of compatibilism, (...) and that they may cast some light on the literature surrounding Frankfurt cases. I also suggest a way in which mature philosophical convictions about free will may reflect a contingent process of refining and defending either of two competing strands of intuitions, and suggest that this may partly explain the persistence of philosophical debates about free will. In this paper, we draw on developmental findings to provide a nuanced understanding of background emotions, particularly those in depression. We demonstrate how they reflect our basic proximity (feeling of interpersonal connectedness) to others and defend both a phenomenological and a functional claim. First, we substantiate a conjecture by Fonagy & Target (International Journal of Psychoanalysis 88(4):917–937, 2007) that an important phenomenological aspect of depression is the experiential recreation of the infantile loss of proximity to significant others. Second, we argue (...) that proximity has a particular cognitive function that allows individuals to morph into a cohesive dyadic system able to carry out distributed emotion regulation. We show that elevated levels of psychological suffering connected to depressive background emotions may be explained not only in terms of a psychological loss, but also as the felt inability to enter into dyadic regulatory relations with others—an experiential constraint that decreases the individual’s ability to adapt to demanding situations. In this paper I criticize libertarianism and skepticism about free will. The criticism of libertarianism takes some steps towards filling in an argument that is often mentioned but seldom developed in any detail, the argument that libertarianism is a scientifically implausible view. I say "take some steps" because I think the considerations I muster (at most) favor a less ambitious relative of that argument. The less ambitious claim I hope to motivate is that there is little reason to believe that (...) extant libertarian accounts satisfy a standard of naturalistic plausibility, even if they do satisfy a standard of naturalistic compatibility. The argument against skepticism about free will tries to show (1) perhaps the most prominent form of skeptical argument against the existence of free will does not work, and (2) there is a good general argument against skepticism about free will. Both legal and moral theorists have offered broadly “communicative” theories of criminal and moral responsibility. According to such accounts, we can understand the nature of responsibility by appealing to the idea that responsibility practices are in some fundamental sense expressive, discursive, or communicative. In this essay, I consider a variety of issues in connections with this family of views, including its relationship to free will, the theory of exemptions, and potential alternatives to the communicative model. Focusing on Michael McKenna’s Conversation (...) and Responsibility, I argue that communicative accounts, and the conversational model in particular, direct our attention to important and under-appreciated elements of our responsibility practices. However, rather than focusing on a model of conversation-as-address, as McKenna does, we do better to regard gossip as the paradigmatic conversational form that captures the main features of moral responsibility.
